The Fifth Circuit developed a set of inquiries the courts should consider in determining whether a worker satisfies the nature element of the connection test for seaman status in its en banc decision in Sanchez v. Smart Fabricators. This presentation will discuss the decisions of the Fifth Circuit, the district courts, and the state courts as they have applied the Sanchez inquiries to determine whether a worker is a seaman.
