The Right of Publicity: NIL and Beyond

The Right of Publicity, one of the four branches of the Privacy Tort, has a bit of a complicated history.  Two recent developments show the increasing importance of the right.   Recently, amateur athletes have been taking advantage of opportunities to use their name, image and likeness for commercial gain.  The Allen Toussaint Legacy Act extends the Right of Publicity to include deceased celebrities.  This presentation will focus on the existing Right of Publicity and the important changes embodied in these statutes.
