Workplace Investigations: When, Who, and How to Advise Your Clients
 

Employment lawyers are often the first call when a client faces a workplace complaint. But investigations carry risks that can impact privilege, litigation strategy, and client relationships. This session will examine how employment lawyers can guide their clients through the threshold questions of when an investigation is necessary, who should conduct it, and how to preserve privilege along the way. The focus will be on the lawyer’s role as counselor and strategist — helping the client navigate a stressful and uncertain time by providing a clear roadmap of investigation considerations and process, without prejudging the complaint or overstepping into the investigator’s role.  The program will also explore how to manage the dynamic between the investigator, the client, and the advising employment lawyer, particularly when navigating the investigation outcomes.

Trends and Updates from the NLRB and in Labor Law
 

The hour of CLE will talk about the changes at the NLRB since the new Presidential administration started, focusing on the enforcement priorities of the NLRB, and the management-side bar’s testing of the constitutionality of the NLRB’s form and powers.

Algorithms at Work: Key Intersections Between AI and Employment Law (Professionalism)
 

We will examine the developing intersection between artificial intelligence technologies and federal and Louisiana employment law issues. The goal is to provide some current and predictive guidance about AI workplace compliance and professional practice in the area in a developing age. The rapid evolution of this technology presents multiple potential ethical and professional pitfalls that the practitioner needs to be aware of, particularly provisions of Louisiana’s Code of Professionalism implicating the use of technology.  This session addresses five critical areas where AI implementation intersects with established legal frameworks: hiring and recruitment; workplace privacy considerations; guidance on electronic surveillance that impacts AI-powered employee monitoring; the reasonable accommodation processes while maintaining required human oversight; and practical risk management strategies.
