This presentation addresses the execution of judgments generally and issues that arise in divorce and family litigation. The speaker will address (1) the enforcement of judgments for the payment of money, (2) garnishment of property in the hands of third parties, (3) involuntary income assignments, (4) out-of-State orders for support, (5) exemptions that apply according to the status of the debtor, the nature of the debt (e.g., child and spousal support), and the assets from which debts might be satisfied, (6) consumer protections that limit garnishments under Louisiana and federal laws, including the federal Consumer Credit Protection Act, (7) the special rules that apply when the garnishee is a bank or a state or federal or state government agency, and (8) special considerations for executing against the debtor’s interest in business entities, such as corporate stock, LLC membership interests, and partnership interests.
